Bail Hearing Wednesday in Sparks Trespass Killing

Posted: Updated:
A lawyer for a 73-year-old Sparks man accused of murder in the fatal shooting of an unarmed trespasser has waived his preliminary hearing and says they are ready to go to trial to prove he acted in self-defense.

A judge has scheduled a hearing in Washoe District Court Wednesday to consider lowering Wayne Burgarello's $2 million bail.

The ex-school teacher is charged with killing a 34-year-old man and seriously wounding a woman he found inside a vacant home he owns in February.

His lawyer, Theresa Ristenpart, says there's been a rush to judgment among some regarding the applicability of Nevada's "stand your ground" law.

Ristenpart says such laws have become a "politically charged issue" nationally. She's asking the public and media not to "imply such political overtones" in Burgarello's case.   (AP)
