The Sparks Police Department says a man is behind bars on open murder charges for the death of his five-month-old son.

Police say they responded to an apartment in the 1800 block of El Rancho Boulevard last Thursday night at 8:15 p.m. for an infant not breathing. Officers say the infant was unresponsive but didn't have any obvious signs of trauma. The infant was taken to the Renown Regional Medical Center for treatment and police say he died Saturday.

While the boy was hospitalized, police continued their investigation. Police learned the boy was in the care of his father, 35-year-old Roberto Diaz-Tenorio when the infant lost consciousness. Police say once the boy was hospitalized, they found several internal injuries consistent with child abuse including brain hemorrhaging and rib fractures.

Diaz-Tenorio was arrested on child abuse charges Friday, before the boy died. The Sparks Police Department says the charges are now being amended to open murder.

Investigators say the abuse may have been ongoing, "Obviously a lot of this is preliminary and we're waiting for tests to come back but there is indication that that's the case" Lieutenant Commander Brian Miller with the Sparks Police Department said in an interview Tuesday afternoon.

Police do not believe the child's mother was aware of the alleged abuse.
