Suit Would Block Trucks Hauling Ore at Mine

Posted: Updated:

Opponents of open pit mining on the edge of a national historic landmark in northern Nevada City have filed a lawsuit aimed at stopping trucks from hauling gold and silver ore on a local highway.

The Comstock Residents Association is suing Comstock Mining and Storey County. It says the county is improperly allowing Comstock Mining to haul ore along Nevada 342 at "substantial risk" to the public. The county maintains it has no authority to prohibit use of the road.

Comstock Mining started acquiring property and mining claims across 6,000 acres around Virginia City in 2003. The company has identified potential gold and silver resources valued at nearly $5 billion.

In addition to safety concerns, critics say the mining runs counter to the best interests of protecting the area's history.
