Storey County Commissioners approved a special use permit for Comstock Mining Incorporated late Thursday night.
It's to use part of Highway 342 near Gold Hill to move ore from the mine to a processing site.
It was approved 4-2 on the condition that Comstock Mining, Inc. put up safety parameters, including not driving on the road when it's icy, along with not driving on the weekends.
Company officials say using the highway is just a temporary fix until the dispute is resolved, but some residents are concerned.
"Now, they want to put us at risk on our ordinary, main two-lane street by putting heavy trucks up and down that street continuously," said Joe McCarthy of the Comstock Residents Association.
Members of the Association say having trucks running up and down Highway 342 will not only be loud, but cause damage to the roadways.
Those who live in the Virginia City area are concerned more accidents will occur if those trucks are using the road all day long.
"I have to use the road to commute to work," said Allison Woodman of Silver City. "I use that road with my little daughter in the car."
Comstock Mining, Inc. says the vehicles they would drive on that road are much smaller than the ones used in the mining pits.
"They're street legal, street tires, completely safe," said Corrado De Gasperis, the President and CEO of the Comstock Mining, Inc. "A completely different version of truck."
