More than a year after President Obama pulled Yucca Mountain's funding off the table -- the future of the project is still unclear.

But now a date has been set where a decision could be made.

On March 22nd, a Washington, D.C. appeals court will hear oral arguments in the lawsuit hoping to get Yucca back in the running as the nation's nuclear waste dump site.

South Carolina, Washington state, and three Washington state business owners all claim the Obama administration overstepped its authority by cutting funding for Yucca and now the case is finally moving forward.

Plaintiffs argue the shutdown leaves states dealing with tons of radioactive material originally promised to be buried here in the Silver State.

But the Energy Department argues the Obama administration has the right to change federal nuclear waste policy.
