The civil suit against Pittsburgh Steelers quarterback Ben Roethlisberger is on hold in Nevada awaiting a high court decision.
The Nevada Supreme Court is looking at the suit filed by Lake Tahoe casino employee Andrea McNulty.
It's part of the pre-trial deciding where the case should be tried.
A district judge originally ruled the trial should be held in Reno but Roethlisberger and his lawyers appealed to switch the case to Douglas County where the alleged assault took place.
The suit first filed in July 2009 accuses Roethlisberger of six charges including sexual assault and battery and false imprisonment.
The Washoe County case is now on hold.
