Lawsuit seeks to block Nevada convention smoking

Associated Press - December 22, 2009 1:05 PM ET

CARSON CITY, Nev. (AP) - The American Cancer Society is suing the Las Vegas Convention and Visitors Authority, seeking to invalidate a newly enacted state law allowing smoking at some trade shows.

A complaint filed Dec. 8 in Carson City District Court says lawmakers violated a state Constitution single-subject rule when they added a provision easing a state anti-smoking law to a bill making stalking a crime.

The lawsuit seeks to void the smoking provision so the law only addresses stalking.

The lawsuit was filed the same day the stalking and smoking measure, AB 309, took effect. The date also marked the third anniversary the 2006 Nevada Clean Indoor Air Act.

That initiative, approved by voters, prohibits smoking in restaurants, shopping malls, schools and day-care centers. Smoking is still allowed on gambling floors of casinos.
